IRS enforcement efforts around §4980H offer of coverage requirements and §§6055 and 6056 employer reporting requirements continue to increase, resulting in some employers having to pay out employer shared responsibility payments and reporting penalties. With relief no longer available for good faith reporting efforts, it is more important than ever for employers to make sure that reporting on Form 1094-C and Form 1095-Cs is complete and accurately reflects the coverage offered to full-time employees. In addition, all employers offering self-funded (or level-funded) group health plans must report for all covered individuals, including in those states now requiring reporting at the state level.
